An attorney is not usually hired until the gross up and concession are negotiated and set forth on the contract. Is the inclusion of the gross up and concession in the contract sufficient for full disclosure? An attorney is not permitted to aid in the unauthorized practice of law and therefore must exercise professional judgment to determine whether the entity is engaged in the unauthorized practice of law. Whenever a law-related web site is offering services that go beyond merely a ministerial function of providing a legal form to Users, the attorney should be on alert that the company may be engaged in the unauthorized practice of law. An attorney is a more effective counselor if he or she has developed this capacity. If we want our attorneys to act as professionals and as counselors - and not just as “hired guns” who attend only to the bottom line and the billable hour - then we must enable and expect them to develop this skill as early as possible in their careers.

An attorney is qualified and licensed to represent a client in court. By most definitions, an attorney may act on the client?s behalf and plead or defend a case in legal proceedings. An attorney is not required to represent you for Social Security claims. You may use anyone who is knowledgeable of Social Security regulations and law or represent yourself. An attorney is your representative in court. No one else you will see in the courtroom is rightfully entitled or obligated to protect your rights.

An attorney is the executor or administrator of an estate or is attorney for the estate. In settlement of the estate, real estate or other assets belonging to the estate are sold. An attorney issues an exemption certificate to a private investigator for work on a case. The investigator does not charge the attorney sales tax. An attorney is not certified by the Texas Board of Legal Specialization, the Louisiana Board of Legal Specialization, the Ohio State Bar Association, or any other body certifying specialization, unless the certification is specifically noted in the attorney’s biography.
